舉例:
今天1號車主賣了一部未告知有撞車的轎車(未告知甲車商)，甲車商買了之後脫手賣給乙車商(甲車商也沒有告知)。幾天後2號車主來看這部車，乙車商因為不知情加上稍微的疏忽沒發現車子有撞過。2號車主滿意的買下了這部車，幾天後車子開去其他保養場，並且發現這是台撞過的車，2號車主不滿意的和乙車商要求賠償否則提告。

那請問如果非得提告是否要上溯至1號車主而非乙車商呢??
