勞保方面
要有一年年資(這家公司)+小孩未滿3歲
辦理育嬰留職停薪，向勞保局申請留職停薪育嬰津貼
嚴格來講，這是就業保險法的給付，保費是含在勞保費裡。
若你在這家公司投保未滿一年，或小孩已滿3歲，就無法申請
必須先按性別工作平等法辦理育嬰留職停薪，才能請領就業險法的育嬰留職停薪津貼。
金額就是你的投保薪資六成，最長請領6個月。

當然..你這是違法，若被查到，就是保費不退，年資不計，已領給付處以二倍罰鍰
法律責任就看勞保局是否採取行動?
