(法律)拍攝及肖像權/隱私權問題?

我常常在YouTube或者生活中看到有人發生車禍或者爭執時其中一方拿起拍攝器具錄影或者拍攝對方，這時對方總會說你侵犯到我的隱私權或者肖像權了。

我在網路上找到的資料是，拍攝對方雖然不會有刑事責任，但是可能會有民事責任。

不過就算你有拍攝對方但是如果沒有用此影帶/照片做出不合理(商業、毀謗)等事蹟，基本上就沒事了。

我想要問的是，這樣真的有觸法嗎?
