刑法
第 19 條
行為時因精神障礙或其他心智缺陷，致不能辨識其行為違法或欠缺依其辨識而行為之能力者，不罰。

監獄行刑法
第 11 條受刑人入監時，應行健康檢查；有下列情形之一者，應拒絕收監：
一、心神喪失或現罹疾病，因執行而有喪生之虞。
二、懷胎五月以上或分娩未滿二月。
三、罹急性傳染病。
四、衰老、身心障礙，不能自理生活。
