車禍我能告對方.能勝訴嗎

3月份我女兒騎腳踏車去超商買東西.要回家時.被一台汽車轉彎撞到我女兒.是在一條沒紅綠燈卻有雙黃線的路口撞到的.有報警.可是警員未到.我到場時.未拍照存證.我女兒腳踏車有被移動.我女兒左腳.瘀青.腫大.卻對方不理不睬.連一通電話也沒有.事隔半個多月.對方保車險的保險公司.傳一通簡訊.才得知對方全托給保險公司.在4月份我聯絡對方的保險公司.來談和解.談不成理賠金.破局.直到現在對方與保險公司.都毫無音訊.根本不當有這回事.我能直接提告嗎.我也不知警方是否有調監視器.
