除斥期間與消滅時效

關於下列二者描述何者正確?

(A)消滅時效當事人並未加以主張援用，法院仍然應當依據職權，親自將之援用，以 作為裁判之依據。
(B)除斥期間者，乃指權利所預定存續之期間，此一期間過後，權利當然消滅，但若 當事人重新主張，則該期間許以展期。
(C)消滅時效與除斥期間兩者比較上，消滅時效之起點算於民法上設有一般規定，以 請求權行使時或行為時充作起算點，除於各該法條有所規範外，為涉有一般性之規 定，解釋上乃以權利成立完全成立之時作為起算點。
(D)消滅時效所消滅之權利多為形成權，除斥期間所消滅之權利多為請求權。
